Stevensville Woman Killed In Missoula Crash

A Stevensville woman was killed in a three-car accident on Wednesday in Missoula.

Kerina Rose, 44, was driving Wednesday afternoon when she stopped to avoid a dog crossing Mullan Road, according to Montana Highway Patrol. A man in a pickup truck rear-ended her and forced her vehicle into the path of another pickup.

She was taken to a nearby hospital where she was pronounced dead. A passenger I her vehicle and a man in the second pickup were also taken to the hospital.

Officials say alcohol and speed do not appear to be factors, but criminal charges will most likely be filed against the driver of the pickup that rear-ended Rose’s vehicle. The charges could range from careless driving resulting in death or serious bodily injury to failure to yield.

Missoula Man Injured In Car Accident

A Missoula man, 49, was injured in a car accident on I-90 near Laurel, Thursday.

He was heading eastbound near the West Laurel exit when his vehicle veered off the left side of the road, according to Montana Highway Patrol.

It appears he overcorrected to the right, crossing two lanes of traffic before going off the ride side of the road where the vehicle struck a highway sign, knocking it down, before coming to rest at the bottom of a small hill.

He was taken to the hospital for the minor injuries he suffered in the crash. Alcohol was a factor in the accident, says Montana Highway Patrol.

Reebok Pays $1 Million Fine

Reebok violated the Federal Hazardous Substance Act by not labeling a charm given away with shoes as containing potentially toxic materials. The charms contained lead which can cause brain damage and even death if ingested. Reebok agreed to pay a $1 Million fine for violating the consumer law.

A 4-year-old Minneapolis boy who swallowed the bracelet's heart-shaped pendant died in March 2006. The pendants, made in China, were free gifts included with the purchase of children's shoes. About 300,000 of them were sold between May 2004 and March 2006.

Per the settlement agreement Reebok did not claim they violated the law. The law was created in 1960 to protect consumers from harm. The charms containing lead were a small part of mulitple toys and children's items recalled last year that were made in China.

Originally posted at InjuryBoard by Shannon Weidemann

St. Louis Woman Awarded $1.1 Million in Sexual Harassment Trial

A woman in St. Louis accused her boss of sexual harassment and a jury awarded her $1.1 Million last week. The woman claimed her boss made mulitple sexual advances and finally fired her for resisting. The woman worked for James Neuman's company from December 2004 to April 2005.

She and her attorney, Eli Karsh, claimed that Neuman made repeated sexual advances that she resisted, threw her onto a bed on a trip to Chicago, made frequent sexual innuendoes in her presence, often commented about her anatomy and finally fired her.

She told the jury that as a result she had been unable to have a relationship with a man and suffered depression and anxiety attacks but lacked funds for treatment.

Neuman denied all of the allegations. He claims that the woman was fired because of unsatifactory job perfomance. His attorneys plan to appeal the decision.

Originally posted at InjuryBoard by Shannon Weidemann

Washington Nursing Home Loses License Over Abuse

A six-bed nursing home in Yakima, Washington has lost its license to operate following allegations of abuse from a resident. The nursing home abuse happened at Carol's Country Touch group home. State investigators charged the operator Carol Winters with physical and mental abuse of the residents.

According to the state, Winters would raise her voice when residents weren't eating fast enough and belittle them with cursing and yelling.

One employee said Winters grabbed a resident walking slowly into the home after returning from the eye doctor. She was wearing sunglasses because her pupils had been dilated.

According to the employee, Winters said to the woman: "Come on, woman, you act like you're dying."

The nursing home has since been shut down and all of the residents were moved to different homes. Around one or two homes in the area are shut down every year. The operator of the nursing home had no comment.

If you would like to learn more about nursing home abuse, please visit InjuryBoard's Nursing Home Abuse information page.

Originally posted at InjuryBoard by Shannon Weidemann

New Hampshire Man Awarded $1.75 Million for Medical Malpractice

A man was injured in a car accident, had surgery to fix a broken leg, and wound up blind. He sued the doctors that treated him for medical malpractice and the juror found one of the doctors liable. They awarded the man $1.75 Million.

Initial news reports of the verdict in the Union Leader and the Associated Press quoted Hinz's lawyer, Suzanne McDonough of Boston, saying Hinz's leg surgery could have waited until after his more serious blood loss was treated.

A statement was issued Friday by Rice and David Gould of Boston, who represented Dartmouth-Hitchcock Clinic and Mary Hitchcock Memorial Hospital.

"Our clients provided excellent care to the plaintiff after his motor vehicle accident, and we are therefore disappointed at the jury's verdict against the Dartmouth-Hitchcock Clinic and Dr. Leefmans," the statement said.

The plantiff's attorney argued that her client should have been given blood before doing surgery on his leg. The doctor is already planning to appeal the verdict. Two other doctors were found not liable.

If you would like to learn more about medical malpractice, please visit InjuryBoard's Medical Malpractice information page.

Originally posted at InjuryBoard by Shannon Weidemann

Roundup Car Accident Injures Two

Two people were taken to the hospital after a multiple car accident in Roundup. Two cars collided causing a vehicle slowdown. This in turn caused another chain reaction of accidents.

Montana Highway Patrol trooper Kyle Hayter said, "As a result of the first crash, some vehicles were parked along the road and checking on them-another vehicle then came through and rear-ended a few of them- a few of those cars- causing them to go in the ditch."

The initial accident happened when a driver tried to make a u-turn and was hit by another car. Conditions on the road were slippery due to a snowfall. None of the injuries were considered serious.

If you would like to learn more about car accidents, please visit InjuryBoard's Car Accident information page.

Originally posted at InjuryBoard by Shannon Weidemann
